End User License Agreement

1. Agreement and Parties: This End-User License Agreement ("Agreement") is a legal agreement between you and Refrigeration CycleAnalyst, LLC ("Provider"). You acknowledge that this agreement is between you and the Provider only, and not with Apple, Google, or Amazon (collectively, "Platform Providers"). The Provider, not the Platform Providers, is solely responsible for the application and its content.

2. License Grant: Provider grants you a limited, non-exclusive, non-transferable, revocable license to use the application for personal or business purposes on any compatible device that you own or control, subject to the Usage Rules of the platform from which you downloaded the app.

3. Maintenance and Support: The Provider is solely responsible for providing any maintenance and support services for this application. You acknowledge that the Platform Providers have no obligation whatsoever to furnish any maintenance or support services with respect to the application.

4. Restrictions: You agree not to: copy, modify, distribute, or create derivative works of the application; reverse engineer, decompile, or disassemble any part of the application; or use the application for any unlawful purpose.

5. Warranty: The application is provided "AS IS." To the maximum extent permitted by applicable law, Platform Providers will have no warranty obligation whatsoever with respect to the application. Any claims, losses, or expenses attributable to any failure to conform to any warranty will be the Provider’s sole responsibility.

6. Product Claims and Intellectual Property: The Provider, not the Platform Providers, is responsible for addressing any claims relating to the application, including product liability, legal requirements, or intellectual property infringement claims. In the event of a third-party claim that the application infringes intellectual property rights, Provider is responsible for the investigation and defense of such claim.

7. Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

8. Third-Party Beneficiary: You acknowledge and agree that the Platform Providers (Apple, Google, and Amazon) are third-party beneficiaries of this Agreement, and that upon your acceptance, each Platform Provider will have the right to enforce this Agreement against you as a third-party beneficiary.

9. Limitation of Liability: To the maximum extent permitted by law, Provider shall not be liable for any indirect, incidental, or consequential damages. In no event shall Provider’s total liability to you exceed the amount of fifty dollars ($50.00).

10. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the United States of America and the state in which the Provider is registered.

11. NO PROFESSIONAL ADVICE: The calculations and data provided by this Application are for informational and educational purposes only. They do not constitute professional engineering or refrigeration advice. Users should verify all results with calibrated physical instruments and a qualified professional before making equipment adjustments or diagnoses. Provider is not responsible for any equipment damage, system failure, or personal injury resulting from the use of this data.
